Terms of Use

These terms govern your use of Hueberry (the "App"), a coloring app for children aged 3–8. They are addressed to the parent or guardian who installs the App. By downloading or using the App, or allowing a child in your care to use it, you agree to them. If you do not agree, do not use the App. How we handle data is described in the Hueberry Privacy Policy.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your family’s own non-commercial use. You may not copy, modify, reverse-engineer, resell, or redistribute the App or any part of it, except where that restriction is prohibited by law.

For parents

The App is designed for young children to use on their own, but a parent or guardian is responsible for their child’s use of it and for any purchase made on their Apple Account. Purchases, links out of the App, saving to Photos and deleting pictures sit behind a parental gate (an adult-level question). The gate is a safeguard, not a guarantee; you can also use Screen Time and Ask to Buy on your child’s device to control purchases.

No account

The App has no accounts and no login. Your child’s pictures, progress and settings are stored only on your device. We cannot see them, and we cannot recover them if you delete the App, lose your device, or reset it.

Free pictures

Every pack includes pictures that are free to color, with no time limit and with the same tools as the rest of the App. The other pictures are unlocked by Hueberry Plus.

Hueberry Plus

Hueberry Plus is an optional one-time purchase that unlocks the App’s locked pictures. It is not a subscription: nothing renews, there is no free trial, and there is nothing to cancel. It is processed by Apple, charged to your Apple Account, and governed by Apple’s terms as well as these. The price is shown in the App before you buy and varies by region.

• Restoring: the purchase is tied to your Apple Account and can be restored on any device signed in to the same account, from the Grown-ups tab → Restore a purchase, or from the Hueberry Plus screen.
• Refunds are handled by Apple, not by us. Request one at https://reportaproblem.apple.com. We cannot issue refunds directly, but if something has gone wrong, email us and we will help.

Pictures and artwork

The line art, packs, name and design of the App belong to StambaAI LLC. The pictures your child colors are yours: you may save them to Photos, print them and share them for personal, non-commercial purposes. You may not extract, sell or redistribute the App’s uncolored artwork or packs, or use them to train machine-learning models.

No ads

The App shows no advertising of any kind, on the free version or with Hueberry Plus.

Availability and changes

Coloring works offline; an internet connection is needed only to show the price and to buy or restore Hueberry Plus. We may update, change, or discontinue the App or any feature at any time. We may update these terms; material changes will be reflected by a new effective date on this page, and continued use after that constitutes acceptance. A change never takes away a purchase you have already made.

Disclaimer and liability

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, StambaAI LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost pictures or lost profits, arising from your use of the App. Our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded, and you may have statutory consumer rights that these terms do not affect.

Apple

Apple is not a party to these terms and has no obligation to provide support or maintenance for the App. Apple is a third-party beneficiary of these terms and may enforce them against you.

Governing law

These terms are governed by the laws applicable at StambaAI LLC's place of establishment, without regard to conflict-of-law rules, and without depriving you of the protection of mandatory consumer law where you live.
